Welcome to The Wine Curator! By using our services, you agree to these Terms of Service. Please read them carefully before subscribing or making a purchase.

1. Who We Are

The Wine Curator offers a curated wine subscription service, delivering hand-selected wines directly to your door each month.

2. Eligibility

To use our services, you must:

• Be 18 years or older (in compliance with Dutch alcohol laws).
• Provide accurate and complete personal and payment information.
• Agree to these Terms of Service.

We reserve the right to refuse service if any eligibility conditions are not met.

3. Subscription & Orders

• Subscriptions are billed in advance. By subscribing, you authorize recurring payments unless canceled.
• Deliveries occur in the first week of each month.
• Wines are curated by us and change monthly. Bottles shown in images are for illustration only.
• The Wine Curator is not responsible for delays caused by shipping carriers.

4. Pricing & Payments

• All prices include VAT but exclude shipping fees (if applicable).
• Payments are processed securely via third-party payment providers.
• If a payment fails, we may suspend your subscription until the issue is resolved.

5. Cancellation & Refunds

• Subscriptions can be canceled at any time before the next billing cycle.
• Due to the perishable nature of wine, we do not accept returns or issue refunds unless the product is damaged upon arrival.
• If you receive a damaged bottle, contact us at thewinecurator@gmail.com within 48 hours of delivery with photos as proof.

6. Corked Wine Policy

• The Wine Curator is not responsible for wines affected by cork taint (TCA contamination).
• However, we are happy to assist you in contacting the producer or distributor for potential solutions.

7. Delivery & Shipping

• We currently deliver within [specify regions/countries if needed].
• Delivery occurs during the first week of each month.
• Customers are responsible for ensuring someone 18+ is available to receive the delivery.
• If a package is undeliverable due to incorrect address details or failed delivery attempts, reshipping fees may apply.

8. Liability & Disclaimer

• The Wine Curator is not responsible for any adverse effects from wine consumption. Drink responsibly.
• We strive to deliver high-quality wines, but we do not guarantee availability of specific bottles or brands.
• We are not liable for any delays, damages, or losses caused by third-party shipping providers.

9. Privacy & Data Protection

• Your personal information is processed in accordance with our Privacy Policy and GDPR regulations.
• We do not share your data with third parties except as required for order fulfillment.

10. Changes to These Terms

• We reserve the right to update these Terms at any time. Any changes will be posted on our website and take effect immediately.

11. Governing Law & Dispute Resolution

• These Terms are governed by Dutch law.
• In case of disputes, we encourage resolving issues through mutual communication. If necessary, disputes may be submitted to the Dutch courts.
